After a married woman with four children submitted a prescription for the morning-after pill, the pharmacist, Neil Noesen, not only refused to fill it, but also refused to transfer the prescription to another pharmacist or to return the prescription (...) to the customer. As more such incidents occurred, many states "... decided to consider and enact laws setting the bounds of pharmacists' and other health care workers' professional obligations" (III, Grady 2006, p. 327). Discussions of objector legislation, also referred to as "conscience clauses," "refusal clauses," and "abandonment laws" (III, Appel 2005, p. 279), are not limited to professional ethics, but also draw from philosophical, theological, and legal perspectives. The purpose of this Scope Note is to present a wide variety of viewpoints on the health provider's right to conscience.More than 40 years ago the development of "The Pill" as the first reliable method of birth control not only ushered in a feminist revolution, but also provided a new focus for concerns of conscience for those who were part of the anti-abortion movement based on religious belief in the sanctity of life. Similarly, in the past ten years, worldwide, and seven years (1999) since the emergency contraception "morning after" pill first became available as a prescription item, there has been an upsurge in the number of medical personnel who refuse to prescribe or dispense it on grounds of personal conscience, whether for religious reasons or not. Their actions bring into play issues of power and control for health care personnel and for patients—in this case women, which also raises women's rights issues. Ironically, studies in France, Sweden, and the United Kingdom have shown that emergency contraception does not reduce the abortion rate—it is too infrequently used (II, Glasier 2006).It is important to underline the difference between the "morning-after" pill or "Plan B," which is made up of two progestin pills containing levonorgestrel (a synthetic derivative of the female hormone progesterone), and RU-486 (Mifiprex [End Page 379] or mifipristone with misoprostol). Plan B, if taken within 72 hours post-coitus prevents implantation, and therefore pregnancy, by suppressing the output of luteinizing hormone, the hormone that triggers the ovulation process. Scientists have been unable to determine whether this action could destroy already fertilized eggs, but even if it does, it uses the same mechanism as occurs with the birth-control pill, that was developed some 45 years ago. By contrast, RU-486 acts up to 49 days after implantation by blocking the action of progesterone in order to terminate the pregnancy and as such is an abortifacient (II, US FDA 1).On 24 August 2006, the U.S. Food and Drug Administration announced approval of the Plan B pill for over-the-counter (OTC ) sales (II, US FDA 2). Although this action makes the drug more widely available, it remains to be seen whether pharmacists who are conscientious objectors and who refuse to dispense it also will refuse to provide it OTC.A survey article by Rebecca Dresser (II, 2005, p. 9) succinctly sums up the problem for conscientious objectors: "Because emergency contraception can act to block implantation of a fertilized egg, people who believe in protection of human life after conception find it morally objectionable."When conscientious objections are raised over abortion or birth control services performed, prescribed, or dispensed, they affect not only the health professionals—physicians, pharmacists, nurses, and health technicians—who may object, as well as their colleagues and/or managers, but also the consumers: the female patients who are then forced to reconsider or to seek an alternative supplier, as well as their spouses or partners. In our commentary we ask whether we should ultimately endeavour to find the deep causes of behaviours? Then we discuss two extensions of the proposed framework: (1) Mendelian randomisation and (2) hypothesis-free gene–environment interaction (leveraging heterogeneity in genetic associations). These complementary methods help move us towards second-generation causal knowledge, ultimately understanding mechanistic pathways and identifying more effective intervention targets.

Despite the worldwide prestige of America's doctoral programs in the humanities, all is not well in this area of higher education and hasn't been for some time. The content of graduate programs has undergone major changes, while high rates of student attrition, long times to degree, and financial burdens prevail. In response, the Andrew W. Mellon Foundation in 1991 launched the Graduate Education Initiative, the largest effort ever undertaken to improve doctoral programs in the humanities and related social sciences. Others leave to have access to assisted suicide in countries that have legalized it: Belgium, The Netherlands, and Switzerland. This new era of globalization in health care has arrived without the benefit of international standards, government oversight, or ethical and legal review.Howard Staab, a self-employed carpenter from North Carolina, flew to India for his medically necessary heart surgery, scheduled a side trip to the Taj Mahal, and returned home to work in North Carolina. He spent a total of less than $10,000, instead of the $200,000 required from the local hospital (I, Milstein and Smith 2006).At first blush, the outsourcing of medical care to India seems to be a particular solution for a particular problem. However, the particularity of Mr. Staab is not unique. This paper aims to reexamine how traditions about the spolia opima developed with special emphasis on two crucial phases of their evolution, the time of Marcus Claudius Marcellus' dedication in 222 BC and the early years of Augustus' principate, following the restoration of the temple of Jupiter Feretrius on the Capitol. In particular, I will argue that Marcellus invented the spolia opima, that his feat shaped the entire tradition about such dedications, and that this tradition was later enhanced and "reinvented" (...) by Augustus, probably following upon renewed interest under Julius Caesar. Through an evaluation of the surviving evidence about the three canonical dedicators the possibility is explored that the spolia opima, rather than being an archaic ritual dating back to the regal period, represent a tradition invented by specific individuals at certain well-defined moments in Roman history. Augustus himself, beginning while he was still a child, was influenced by traditions about the career and achievements of M. Claudius Marcellus. Augustus' interest in Marcellus helps to explain his special focus on the spolia opima as a significant and hallowed Roman tradition. Consequently, in the late first century B.C., spolia opima were associated both with old-fashioned "republican" aspirations and also with the iconography and self-definition of the new ruling family. In this context other leading Romans of the age considered dedicating such spolia, notably M. Licinius Crassus, grandson of the triumvir, and the elder Drusus, brother of Tiberius. In addition, Virgil included the spolia opima as a recurring theme in the second half of the Aeneid. The poem reaches its climax when Aeneas kills his rival Italian leader Turnus in a duel which would have entitled him to dedicate spolia opima. (shrink)

QuigleyIn 1878, Charles Sanders Peirce closed the first section of "How to Make our Ideas Clear"—an article that William James later declared a "birth certificate of Pragmatism"—on a strangely anecdotal note.1 Using what would become known as the pragmatic method to demolish the notion of Grand Ideas ("Our idea of anything is our idea of its sensible effects"), Peirce (...) also included a lesson from an "old German story":Many a man has cherished for years some vague shadow of an idea, too meaningless to be positively false; he has nevertheless, passionately loved it, has made it his companion by day and by night, and has given to it his strength and his life, leaving all other occupations for its sake, and in short has lived with it and for it, until it has become, as it were, flesh of his flesh and bone of his bone; and then he has waked up some morning to find it gone, cleaned vanished away like the beautiful Melusina of the fable, and the essence of his life gone with it. Peirce's inclusion of an anecdote about his own loneliness—"I have myself known such a man"—is poignant even as it reveals his anger. Melusina is both a monster and "beautiful," and with her disappearance, Peirce has lost, "the essence of his life." The personal allusion also highlights the anxiety in the young Peirce's writing. What if his theories came to nothing, remained merely vague, and he lost his whole life and his wife to a misguided dedication? And how ironic would that be given that the idea itself aimed to explode the fallacy of grand ideas? Such an irony was not lost on his main companion during the winter of 1875, Henry James.In the following pages I aim to demonstrate that Charles S. Peirce's anxiety acted as a germ for the beast of John Marcher in James's late story, "The Beast in the Jungle." First, under what conditions, if any, can a Black person trust a white person to be a reliable ally in the context of a society founded on racial slavery? Second, under what conditions, if any, can a Black person trust a white person to be a reliable ally in the context of a white supremacist society? We follow Karen Jones and Nancy Nyquist Potter in arguing that allies must not only be competent, (...) conscientious, and accurately self-assess their epistemic capacities, but they must also signal their trustworthiness in advance to those who would trust them. Furthermore, we argue based on our readings of the slave narratives of Mary Prince, Harriet Jacobs, and Frederick Douglass that allies must display social awareness of the social context that they share with those who would trust them and the power dynamics involved in that social context. This volume publishes the papers which were offered and discussed by a group of philosophers and psychologists during a conference "designed to explore the interrelations between philosophical analyses of the family of concepts relating to the self... and empirical studies in psychology of the development and manifestations of self-control, self-knowledge, and the like," held in Chicago in 1975. The late editor arranged the papers "in terms of four topics" indicating the major themes they address. After his introduction, "Conceptual Issues in (...) the Psychology of the Self", written after the conference and intended as an harmonization of opposing views expressed in the discussions, he presents three papers concerned with psychological and philosophical aspects of "Self-Control and the Concept of Agency." In "Self-Control and the Self," Walter and Harriet N. Mischel start with "an overview of some of the main types of self-control that psychologists have researched". Such psychological studies reveal the human being as "an active, self-aware problem-solver, capable of changing himself and achieving substantial self-control through the application of rational principles to a much greater degree than has usually been supposed in psychology". William P. Alston intends to determine in what ways the self has to be taken into account in the psychology of motivation in "Self-Intervention and the Structure of Motivation". That "there is an agent that does the integrating... and so on," is to be recognized as a fact. The understanding of this self-intervention, however, demands the admission of at least two motivational systems of higher-level-wants and of lower-level-wants, differing in structure and in the mode of acquisition. Charles Taylor explores "what is involved in the notion of self, of a responsible human agent" in his paper, "What is Human Agency". A person is found to be essentially characterized by the capacity for reflective self-evaluation. "Self-Knowledge" is discussed in the following two articles. Kenneth J. Gergen defends "The Social Construction of Self-Knowledge" in line with ideas of George Herbert Mead. Self-knowledge is "primarily a socially mediated and essentially arbitrary construction of experience". In its case "there is virtually nothing to know". This socio-cognitive conception of the self is emphatically rejected by David W. Hamlyn in his "Self-Knowledge". Knowledge about oneself as studied in psychology and sociology is essentially different from self-knowledge in the full sense, "connected with some kind of commitment to oneself". Different scientific views of certain aspects of human existence are presented in "Self-Development and Its Failures". Freud’s conception of the human person finds a realistic correction in the theoretical and practical work of contemporary psychoanalysts insisting upon the need of the concept of a "cohesive self," as described in Ernest S. Wolf’s "'Irrationality’ in a Psychoanalytic Psychology of the Self". This need is denied in behavioristic psychology, as Willard F. Day, Jr. shows in "On the Behavioral Analysis of Self-Deception and Self-Development". "To a behaviorist, there is no such thing" as the self. Consequently, there cannot be a genuine self-development as distinguished from a progress toward creating a desirable environment. Self-deception means fighting the environment. "A Critique of the Behavioral Paradigm and an Alternative Conceptualization" is offered by Paul F. Secord in an analysis of "Making Oneself Behave". Meaning and deficiencies of the understanding of the self in sociological social psychology are outlined by George J. McCall in "The Social Looking-Glass: A Sociological Perspective on Self-Development". The self is seen as essentially a social self or looking-glass self. Problems with regard to an explanation of the personal choice of behavior of a determined social role, however, seem to demand impulses as well as institutions as a locus of self-appraisal. "The Meaning of ’self’ and the Multiplicity of Selves" is the title of the last section of the book. Various uses of the term ’self’ are distinguished by Stephen E. Toulmin in "Self-Knowledge of the Self". The author is primarily concerned with establishing the relations of even the sophisticated psychological and psychiatric uses of the term to the everyday experience and language of reflective conduct. Today, she gives her name to the journal for feminist philosophy. She is a symbol for those women who, over the centuries, have struggled to be part of the philosophical life of their time.Until very recently, the centuries that separated Hypatia from the present were assumed to have been a philosophical desert for women. But times have changed. Hypatia’s Daughters is a sign of this change. It contains eighteen articles on seventeen philosophers: Hypatia; Hildegard of Bingen, Heloise, and Christine de Pisan from the Middle Ages; Elizabeth of Bohemia, Sor Juana de la Cruz, Anne Conway, Damaris Masham, Catharine Trotter, Belle van Zuylen and Mary Wollstonecraft from the seventeenth and eighteenth centuries; Anne Doyle Wheeler and Harriet Taylor Mill from the nineteenth; Charlotte Perkins Oilman, Edith Stein, Hannah Arendt, and Angela Davis from the late nineteenth century into contemporary times. Few are known as well as they deserve, but many names are familiar even to non-specialists. Their ideas, however, are another matter.The collection in no way constitutes a definitive selection of women philosophers; those discussed are not presented as the most significant women philosophers in the history of philosophy. (A different kind of study would be necessary for evaluations of that kind.) The women here studied have little in common as a group; they wrote on many topics of philosophical concern; their views and their supporting reasoning differ. Further, as the subjects of the articles differ in their ideas, so do the contributors’ approaches and their methods of studying those ideas differ. These differences are the strengths of a collection that is stimulating, enlightening, provocative. The following examples indicate their range.Andrea Nye examines the correspondence of Heloise and Abelard and, in a second article, of Elizabeth of Bohemia and Descartes. Heloise and Elizabeth are usually regarded as passive followers or, at best, no more than serious questioners seeking answers of their correspondents. Nye’s fresh look at the Heloise-Abelard correspondence finds not only important differences between two ways of thinking, but also sees already underlying their disagreement what she calls the “macroquestion” of philosophy’s future: philosophy as “a professional discipline independent of political or social concerns or... an ongoing critical and cultural discourse.” (25) Elizabeth’s persistent questions to Descartes reveal ideas that challenge his views, especially on moral issues and physiological-psychological [End Page 164] phenomena; these are views that have a greater complexity than the basic issue of mind-body interaction that is usually identified as central to their exchange.Writing on Harriet Taylor Mill, Jo Ellen Jacobs examines changing attitudes towards her subject, beginning with views of Taylor Mill’s contemporaries and moving through the decades into our time. She finds parallels between criticisms of Taylor Mill and attitudes towards the so-called intellectual woman. In times encouraging of women, Taylor Mill is regarded as having made important contributions to the development of J. S. Mill’s thinking, in addition to writing and speaking about her own ideas and positions that did not always follow those of J. S. Mill. In less encouraging times, her significance tends to be minimized.Hannah Arendt is not usually thought of as a feminist. Joanne Cutting-Gray, through her discussion of Arendt’s early book on Rahel Varnhagen, develops implications of that study for Arendt as a “feminist thinker,” in particular through her focus on “the politics of alterity.” Cutting-Gray finds in the Varnhagen biography “an analogy between Jewish and female alterity [that] can stretch our understanding of women and politics.” (281)And there is more, much more: Martha Brandt Bolton’s scholarly examination of the philosophical works... This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

ABSTRACT Tibor R. Machan's ‘The virtue of freedom in capitalism’, which recently appeared in this journal, seeks to defend the currently fashionable view that capitalism and freedom are closely linked. I concentrate upon three aspects of his argument. First, Machan holds that capitalism is the only system capable of facilitating the exercise of moral responsibility effectively. Against this, I show that his argument rests upon a systematic confusion between two distinct theses. Secondly, I deal with his attempt to rest an (...) argument upon the allegedly ‘uncoercive’ nature of market exchanges. Thirdly, I show that his analysis of the concept of freedom, which closely follows Hayek, logically cannot be deployed in support of the free market. Machan has a tendency to appeal to ‘tradition’, and so, in conclusion, I briefly consider his relation to the ‘analytic’ movement in philosophy. (shrink)

According to the Argument for Autonomous Mental Disorder, mental disorder can occur in the absence of brain disorder, just as software problems can occur in the absence of hardware problems in a computer. This article argues that the AAMD is unsound. I begin by introducing the “natural dysfunction analysis” of disorder, before outlining the AAMD. I then analyze the necessary conditions for realizer autonomous dysfunction. Building on this, I show that software functions disassociate from hardware functions in a way that (...) mental functions do not disassociate from brain functions. Sabellianism, the doctrine that the Persons of the Trinity are roles that a single divine being plays either simultaneously or successively, is commonly thought to entail that the Father is the Son. I argue that there is at least one version of Sabellianism that does not have this result and meets the requirements for a minimally decent doctrine of the Trinity insofar as it affirms that each Person of the Trinity is God and that the Trinity of Persons is God (...) while maintaining monotheism without undermining the distinctness of Persons. Justin Garson has recently advanced a Generalised Selected Effects Theory of biological proper function. According to Garson, his theory spells trouble for the Dysfunction Account of Disorder. This paper argues that Garson’s critique of the Dysfunction Account from the Generalised Theory fails, and that we should reject the Generalised Theory outright. I first show that the Generalised Theory does not, as Garson asserts, imply that neurally selected disorders are not dysfunctional. Rather, it implies that they are both functional and dysfunctional. The archive can take many forms but all are marked by a connective sequence: archive, memory, the past, narrative. The author explores this sequence through an account of her engagement with four different types of archive, constructing a phenomenology of the archive which highlights the promises and seductions offered to the researcher. Postmodern questioning may throw in doubt older conceptions, whereby the archive is used to legitimate knowledge claims about the past of a nomological nature. However, in a context where (...) intellectuals become interpreters rather than legislators, the role of the archive as repository of inert meanings is strengthened rather than weakened; using the archive helps us to understand the dialectical nature of the relationship between past and present and our own positioning within this. This bibliography seeks to offer a comprehensive overview of nuclear criticism, tracing its development from the 1984 issue of diacritics which saw the publication of Derrida's seminal article “No Apocalypse, Not Now ” to the present day. Particular attention is paid to areas of interest which are underrepresented in the available literature, and every attempt has been made to offer a resource which is wide-ranging in outlook while providing a clear sense of the central texts which have shaped and reshaped (...) what we understand as nuclear criticism. Texts focusing solely on individual works have, by and large, been excluded. Brief notes accompany some of the entries, although it has not been practical to provide these for all the works mentioned: they should be taken as a record of an individual approach to the texts in question rather than as marks of overarching significance.
